3.1 Rights to object

Please note the following regarding the right to object:

If we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without providing reasons. This also applies to profiling, insofar as it is related to direct marketing.

In the event that we process your data to safeguard legitimate interests, you may object to this processing at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves to assert, exercise, or defend legal claims.

3.2 Purposes and Legal Bases of Data Processing

When processing your personal data, we comply with the provisions of the EU GDPR and all other applicable data protection regulations. The legal bases for data processing are derived in particular from Article 6 of the EU GDPR.

We use your data to initiate business relationships, to fulfill contractual and legal obligations, to execute the contractual relationship, to offer products and services, and to strengthen customer relationships.

Your consent to data processing may also constitute a legal basis under data protection law. Before you give your consent, we will inform you about the purpose of the data processing and your right to withdraw consent.

The objection may be made free of charge and without any specific formality, without the need to provide reasons, and should preferably be directed to +49 30 399 84-0, by email to datenschutz@alre.de, or by mail to ALRE-IT Regeltechnik GmbH, Richard-Tauber-Damm 10, D-12277 Berlin.

3.3 Disclosure to Third Parties

We will only disclose your data to third parties within the scope of legal provisions or with your consent. Otherwise, no disclosure to third parties will take place unless we are required to do so by mandatory legal provisions (disclosure to external bodies such as supervisory authorities or law enforcement agencies).

3.4 Recipients of the data / Categories of recipients

Within our company, we ensure that only those individuals who need your data to fulfill contractual and legal obligations receive it.

In certain cases, IT service providers in particular assist our departments in fulfilling their tasks. The necessary data protection agreements have been concluded with all service providers.

3.5 Transfer to third countries / Intention to transfer to third countries

Data transfers to third countries (outside the European Union or the European Economic Area) only take place to the extent that this is necessary for the performance of the contractual relationship, required by law, or you have given us your consent.

We transfer your personal data to service providers or group companies outside the European Economic Area, namely Ireland and the United States. Compliance with data protection standards is ensured through EU Standard Contractual Clauses and binding corporate data protection policies.

3.6 Data Retention Period

We store your data for as long as it is required for the respective processing purpose. Please note that numerous retention periods require that data continue to be stored. This applies in particular to retention obligations under commercial or tax law (e.g., the German Commercial Code, the German Fiscal Code, etc.). Unless further retention obligations apply, the data will be routinely deleted once the purpose has been fulfilled.

In addition, we may retain data if you have given us your consent to do so or if legal disputes arise and we use evidence within the scope of statutory limitation periods, which can be up to thirty years; the standard limitation period is three years.

3.7 Secure Transmission of Your Data

To protect the data stored with us as effectively as possible against accidental or intentional manipulation, loss, destruction, or access by unauthorized persons, we implement appropriate technical and organizational security measures. Security levels are continuously reviewed in collaboration with security experts and adapted to new security standards.

Data exchange to and from our website is always encrypted. We use HTTPS as the transmission protocol for our website, always employing the latest encryption protocols.

3.8 Obligation to Provide Data

Various personal data are necessary for the establishment, performance, and termination of the contractual relationship and the fulfillment of the associated contractual and legal obligations. The same applies to the use of our website and the various functions it provides.

We have summarized the details for you in the section above. In certain cases, data must also be collected or provided due to legal requirements. Please note that processing your request or fulfilling the underlying contractual relationship is not possible without the provision of this data.

3.9 Categories, Sources, and Origin of Data

The specific context determines which data we process: This depends on whether, for example, you place an order online or submit an inquiry via our contact form, whether you send us a job application or file a complaint.

Section 5.4 lists the data we store when you visit our website. This consists of pseudonymous data that does not allow for a clear association with your person.

Please note that we may also provide information for specific processing situations separately in the appropriate place, e.g., when uploading application documents or submitting a contact request.

3.10 Automated Individual Decision-Making

We do not use purely automated processing procedures to make decisions.

4. Social Media Links

On our website, you will find links to the social media services of Facebook, Instagram, LinkedIn, and YouTube. You can recognize links to the websites of these social media services by the respective company logo. If you follow these links, you will be directed to our company profiles on the respective social media service. When you click a link to a social media service, a connection is established with the servers of that social media service. This transmits information to the social media service’s servers indicating that you have visited our website. Additionally, further data is transmitted to the provider of the social media service. This includes, for example:

• The address of the webpage on which the activated link is located•
The date and time the webpage was accessed or the link
was activated• Information about the browser and operating
system used• IP address

If you are already logged in to the relevant social media service at the time the link is activated, the provider of the social media service may be able to determine your username and, in some cases, even your real name from the transmitted data and associate this information with your personal user account on the social media service. You can prevent this association with your personal user account by logging out of your user account beforehand.

The servers of the social media services are located in the United States and other countries outside the European Union. The data may therefore also be processed by the social media service provider in countries outside the European Union. Please note that companies in these countries are subject to data protection laws that generally do not protect personal data to the same extent as is the case in the member states of the European Union.

Please note that we have no influence over the scope, nature, and purpose of data processing by the social media service provider. For more information on how your data is used by the social media services integrated into our website, please refer to the privacy policy of the respective social media service.

5. Data Processing on Our Website

5.1 Cookies

Our website uses so-called cookies. They serve to make our website more user-friendly, effective, and secure. Cookies are small text files that are stored on your device and saved by your browser (locally). Cookies contain only pseudonymous, and in most cases even anonymous, data. Some cookies remain active for the duration of a browser session (so-called session cookies), while others are stored for a longer period (so-called persistent cookies, e.g., consent settings). The latter are automatically deleted after the specified time (usually ). In addition to our own cookies, we also use cookies controlled by third-party providers. These providers use the information contained in the cookies to, for example, display content to you or track the pages you visit.

Based on our legitimate interest (Art. 6(1)(f) GDPR), we use technically necessary cookies that are essential for the operation of the website and ensuring its functionality. Furthermore, we use cookies without your consent to the extent that their sole purpose is to store or access information stored on the end device for the transmission of messages, or if they are absolutely necessary to provide the service you have expressly requested, § 25(2) TTDSG.

Subject to your consent, additional cookies are used that enable us or third parties, for example, to analyze how our services are used. This allows us to tailor content to user needs. In addition, cookies allow us to measure the effectiveness of a specific advertisement and to place it, for example, based on the user’s thematic interests. The legal basis for this is your explicit consent (Art. 6(1)(a) GDPR, § 25(1) TTDSG).

You can revoke your consent at any time via our consent banner with future effect and change your cookie settings. Please note that changes must be made separately for each device.

If you maintain accounts with the third-party providers we use and are logged in there, your data may be linked to the respective account. You can prevent such a link by not granting or by revoking your consent to the relevant cookies, or by logging out of the respective third-party providers beforehand.

Most browsers automatically accept cookies. You can also manually disable, restrict, or delete cookies on your device via your browser settings or using software. If you disable cookies, full use of our websites will not be possible or will be limited.

Please also refer to our information in the section of the respective service that uses cookies.

5.2 Google Maps

On our website, we use Google Maps (API) from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). To ensure data protection, Google Maps is disabled when you first visit this website. A direct connection to Google’s servers is only established once you have given your consent to Google Maps via our cookie banner (consent pursuant to Art. 6(1)(a) of the EU GDPR). You can revoke your consent at any time here. This prevents your data from being transmitted to Google the first time you visit the site.

After activation, Google Maps will store your IP address. This is then typically transmitted to a Google server in the United States and stored there.

Additional information on the handling of user data can be found in Google’s Privacy Policy.

5.3 YouTube

We embed videos from the “YouTube” platform, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, into our online offering.

The videos have been embedded in enhanced privacy mode. According to the information provided by the YouTube platform, cookie activity and the resulting data collection are only linked to the use of the video’s playback function itself.

Embedding the videos always results in data being transmitted to the server of the respective platform. These processing operations are based on your consent (Art. 6(1)(a) EU GDPR), which you may revoke at any time here.

For more information on the purpose and scope of data collection and its processing by YouTube, please refer to Google’s Privacy Policy. There you will also find further information regarding your rights and settings options for protecting your privacy.

5.4 Google Analytics

We use Google Analytics to analyze website usage. The data obtained from this is used to optimize our website and advertising measures.

Google Analytics is a web analytics service operated and provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, United States). Google processes website usage data on our behalf and is contractually obligated to take measures to ensure the confidentiality of the processed data.

During your visit to the website, the following data, among others, is recorded:

  • Pages viewed
  • The achievement of “website goals” (e.g., contact requests and newsletter sign-ups)
  • Your behavior on the pages (e.g., clicks, scrolling behavior, and time spent on the site)
  • Your approximate location (country and city)
  • Your IP address (in truncated form, so that no unique identification is possible)
  • Technical information such as browser, internet service provider, device, and screen resolution
  • The source of your visit (i.e., which website or advertising medium brought you to us)
  • This data is transmitted to a Google server in the United States.

Google Analytics stores cookies in your web browser for a period of two years from your last visit. These cookies contain a randomly generated user ID that allows you to be recognized during future website visits.

The recorded data is stored together with the randomly generated user ID, which enables the analysis of pseudonymous user profiles. This user-related data is automatically deleted after 14 months. Other data remains stored in aggregated form indefinitely.

If you do not consent to this data collection, you can prevent it by installing the browser add-on to disable Google Analytics or by rejecting cookies via our cookie settings dialog.

Information regarding the transfer of your data to third countries can be found in Section 3.5

5.5 Google Marketing Platform (formerly DoubleClick)

We use the Google Marketing Platform on this website. This is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

We use the Google Marketing Platform to make your visit to our website as pleasant as possible by integrating Google Maps and YouTube.

The Google Marketing Platform uses cookies, in particular to display advertisements tailored to you. On pages within the Google Partner Network, Google may then target you again with relevant advertising offers, as you have previously visited or used corresponding websites and offers.

The cookies are used to advertise products from this website operator (retargeting). At a later time, the user may be shown advertisements (e.g., banner ads, text-image ads, videos, etc.) on other websites in this regard. Users can opt out of the retargeting functionality by changing the display settings of the Google Remarketing tags or by disabling retargeting. Alternatively, users can disable the use of third-party cookies by using the Network Advertising Initiative’s opt-out page.

The information generated by the cookie may be transmitted to a Google server in the United States and stored there. Google may also use your browser’s IP address to display relevant advertisements. No data will be transferred without your prior explicit consent (Art. 6(1)(a) EU GDPR) via our cookie banner.

You can also disable the use of such cookies by Google via the following link: http://www.google.com/settings/ads.

Please note that without your consent or if you disable these cookies, you will not be able to access the Google services embedded on our website (YouTube and Google Maps).

Please note that the Google Marketing Platform is a service provided by a third-party company (Google) independent of us, and we have no influence over its data processing procedures.

Further information on how Google handles the data collected from you, as well as Google’s additional privacy policies, is available at http://www.google.com/intl/de/policies/privacy/.

5.6 Contact Form / Contact via Email (Art. 6(1)(a), (b) EU GDPR)

Our website b@home features a contact form that can be used to contact us electronically. When you write to us via the contact form, we process the data you provide in the contact form to contact you and respond to your questions and requests.

In connection with a contact request, we collect and process the following data:

  • Name (First/Last Name)
  • Contact information (email)
  • Subject
  • Content of the inquiry (optional)

We adhere to the principles of data minimization and data avoidance by requiring you to provide only the data we absolutely need to contact you. This includes your email address and the message field itself. Additionally, your IP address is processed for technical reasons and to ensure legal compliance. All other data fields are voluntary and may be provided optionally (e.g., to receive a more personalized response to your questions).

To protect the security and confidentiality of your data as effectively as possible, we implement appropriate security measures. Your inquiry is transmitted to us in encrypted form.

If you contact us via email, we will process the personal data provided in the email solely for the purpose of handling your inquiry.

6. Presence on Social Media

We maintain a presence on the social media platforms Facebook, Instagram, LinkedIn, and YouTube. To the extent that we have control over the processing of your data, we ensure that applicable data protection regulations are complied with.

Below you will find the most important information regarding data protection law in relation to our social media presence.

Purpose and Legal Basis

We maintain the fan pages ourselves to communicate with visitors to these pages and to inform them about our offerings in this way.

In addition, we collect data for statistical purposes to further develop and optimize content and make our offerings more attractive. The data required for this (e.g., total number of page views, page activities, and data provided by visitors, interactions) is processed by the social networks and made available to us. We have no influence over its generation or presentation.

In addition, your personal data is processed by social media providers, as well as by ALRE-IT Regeltechnik GmbH, for market research and advertising purposes. This makes it possible, for example, to create usage profiles based on your usage behavior and the resulting interests. This allows, among other things, for advertisements to be displayed both within and outside the platforms that correspond to your interests. Cookies are generally stored on your computer for this purpose. Regardless of this, your usage profiles may also store data that is not directly collected on your end devices. Storage and analysis also occur across devices; this applies in particular, but not exclusively, when you are registered as a member and logged in to the respective platforms.

Beyond this, we do not collect or process any personal data.

The processing of your personal data by ALRE-IT Regeltechnik GmbH is based on our legitimate interests in effective information and communication pursuant to Art. 6(1)(f) of the EU GDPR.

If you are asked to consent to data processing, i.e., if you give your consent by clicking a button or similar (opt-in), the legal basis for the processing is Article 6(1)(a) and Article 7 of the EU GDPR.
